Booking:

The sending of the "booking form" confirms your acceptance of the terms and conditions set out below and as may from time to time be changed and shall be binding by all persons stated on the booking form. Each booking shall be confirmed by the owner, as soon as possible after the owner receives the booking form and the deposit, and only on receipt of this confirmation by you will the booking be treated as confirmed. Once the owners have confirmed the booking to you and you have paid the deposit, the named person on the booking form will be responsible for the total rental price of the property, as agreed on the confirmation. The remaining balance of the agreed rental cost must be paid no later than

4 weeks prior to your date of arrival. The owners require a $200 deposit to hold the dates of the rental. If the full balance of the rental cost is not paid as in accordance with these booking conditions, we reserve the right to cancel your booking and cancellation penalties may apply. An accidental damage insurance policy will be taken out by the owners in the name of the person on the booking form. The cost of the policy is $59 and will be added to the total cost of the rental.

 

Cancellations:

Providing the owners receive written notice of cancellation not less than 12 weeks prior to the actual arrival date, the signatory will not be liable to pay the full balance. It is the responsibility of the signatory to ensure that the signed cancellation letter reaches the owner. Email cancellations will not be accepted. If the owner is successful in re letting the property for all or part of the reservation period the full balance or the part balance of the final cost will be refunded. The owners reserve the right to cancel any bookings providing notice is given and any payment made be refunded. In the unlikely event that circumstances beyond our control, necessitate cancellation of the booking, we will refund any monies paid without interest, compensation or consequential loss of any kind.

Responsibilities:

All persons stated on the booking form are responsible for the care of the property and are expected to take reasonable care of it including the locking of all doors. The Owners are not responsible for any lost or stolen items. At the end of the rental period, all utensils, carpets, furnishings, walls and fittings must be left clean and tidy. Any additional cleaning costs incurred to the owners as a result of actions by

the guests will be the responsibility of the guests.  It is the guest's responsibility to notify the Management Company immediately of any

sudden equipment failure so that reasonable action can be taken to rectify the situation. Appliances shall only be used for their intended use. The Guests are responsible for reporting any and all damages that are observed upon arrival to the property. Non reported damages will be considered current Guest damages. 

 

Party Size:

The property is fully licensed for short-term rentals in Florida. The maximum capacity that our villa is licensed for is 12. Everyone occupying the property must be listed on the booking form, including small children. This is Florida state law and must be adhered to. 

The accommodations cannot be shared or sub-let and only the persons shown on the booking form are permitted to stay in the property. 

Persons under 21 years of age are not acceptable unless accompanied by parents or responsible adults.  The owners reserve the right to refuse admittance if this condition is not met.  If the party size is increased  from the size that was agreed upon at the time when the

booking was confirmed, there will be an additional charge made. The owner will notify the guests  of the additional charge via email and

it will be the responsibility of the person who made the booking to accept the surcharge. If the surcharge is not accepted, the additional guests will not be permitted to stay at the villa.

 

Smoking / Pets:

For the safety and comfort of all of our guests, smoking is not permitted within the property. No pets are allowed.

 

Liability:

The owners and the Management Company accept no responsibility whatsoever for death, personal injury, accidents, loss or damage to persons or personal belongings however caused. The use of all accommodations and amenities, including the pool and spa and all of the amenities of either of  the Windsor at Westside clubhouse, is entirely at the user's own risk. Children must be supervised by responsible adults at all times when using the pool.  Pool safety gates & fence must be kept in place and locked at all times when there is not adult supervision on the pool patio. At any point when the management company observes safety fences have been removed, they will be replaced and the guests will be charged $50.00. The owners or management company cannot accept any responsibility for loss of rental time due to travel problem, flight delays or cancellation, industrial disputes or any event outside of our control. The owners and management company cannot accept responsibility for the sudden failure of villa equipment but will take immediate, reasonable action to rectify any such failure upon notification by the guests. If the pool heater cannot reach optimum temperature due to adverse cold weather conditions, the owners or the Management Company cannot accept liability.

 

Propane BBQ Grill:

Propane BBQ Grill is available for rent through a third party and are in no way controlled by the Owners. Propane BBQ Grills can become extremely dangerous and even fatal, if not handled properly. Grill run-off can also ruin chemical balance of the pools as well as clogging

the filter.

Force Majeure:

The owner or the Management Company accept no responsibility whatsoever and no compensation or other payment will be made if any cancellation or change to the terms of the booking becomes necessary due to war or threat of war, riots, civil commotion, terrorist activities, industrial disputes, natural and nuclear disasters, fire, flood, adverse weather conditions, building or construction in progress within the community, technical problems with transportation, closure or congestion of roads or airports, alterations or cancellation of schedules by carriers, or any other events beyond our control.

 

Owners Access:

The owners or their management company or designated persons shall be allowed access at any reasonable time during your stay.

 

Pool Operation and Heating:

Guests are not permitted to interfere with the workings of the pool nor are they allowed to change any settings that control the pool / spa heat. The pool heat is set at a temperature that is suitable for the Florida climate. If guests have concerns regarding the pool or the temperature, they must contact the Management Company to address these concerns. Pool heating is an option with our rental property and can be added at any time for an additional fee. Pool heaters may take up to 72 hours to heat to optimum temperature from the time that they are turned on.  If the air temperature lowers to 60 degrees F or less, the pool heater may not be very effective and water temperature may not reach a comfortable temperature. This condition is beyond the control of the Owners and Management Company

and any fee paid for pool heating may not be refunded. Random inspections of the pool controls will be made by the Management Company. If there is any evidence found that these have been tampered with, this will warrant a surcharge to the guests. There is No lifeguard on duty at the private pool. Pool use is at the Guests own risk. All diving, horseplay and/or running in the pool area, glass dining ware are prohibited in the pool area.

 

Resort Facilities:

The owner cannot be held responsible for issues and concerns regarding the Windsor at Westside Resort facilities as these facilities are run and managed by a separate agent who is not affiliated to the owners of Westside Retreat. (Due to the ongoing COVID-19 pandemic, some of the facilities and services may not be open or available for use.)

 

Law:

Conduct is subject to and shall be construed in accordance with the laws of the United States of America and the State of Florida and all parties hereby submit to the exclusive jurisdiction of the United States Courts.

 

Code of Conduct:

Windsor at Westside is a residential community. The actions of all members of your party should not interfere with the enjoyment of either other vacationers or the residents of Windsor at Westside. Please do not use the swimming pool, play loud music or engage in any activity which may cause inconvenience to your neighbors after 10:30pm or before 7:30am. In the event that any member of your party behaves in a way that is likely to cause distress, danger or annoyance to any other vacationers, residents of Windsor at Westside or damage to any property, the owners reserve the right to terminate your rental agreement immediately. The owners or their Management Company will not be liable for any costs you will incur, nor shall we pay any compensation, nor make any refunds due to this action.

 

No Daily Cleaning Service:

While linens and bath towels are included with the rental of the villa, daily cleaning service is not included in the rental rate. This is a

self-catering home. If you wish to have daily cleaning service or if you want a mid-stay cleaning, arrangements can be made at an additional cost.

 

Rate Changes:

Rates are subject to change without notice.

 

Falsified Reservations:

Any reservation obtained under false pretense will be subject to forfeiture of advanced payment, deposit, and/or rental money, and the party may not be permitted to check in.
